Welcome to [The Tarte, LLC] (“The Tarte,” “we,” “us,” or “our”). By accessing our website, placing an order, or purchasing any product from us—whether through our website or a third-party platform such as Hotplate—you agree to be bound by the following Terms & Conditions.

The Tarte is a small-batch artisan bakery operating under California Cottage Food Law (Class A). All baked goods are produced in limited quantities, made to order, and offered only when announced.
Our website showcases our creations and may redirect customers to Hotplate, a third-party ordering platform, for placing orders for baked goods. Certain non-perishable items (such as coffee, honey, mugs, and merchandise) may be sold directly through our website.
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including due to limited production capacity, errors, or unforeseen circumstances.
Once an order is placed and confirmed, it is considered final.
All Sales Final - No Refunds, No Returns, No Exchanges
All sales are final.
Due to the perishable, made-to-order nature of our products:
We do not offer refunds
We do not offer returns
We do not offer exchanges
We do not offer substitutions
We do not offer store credit
This applies without exception, including but not limited to:
Change of mind
Scheduling conflicts
Missed pickups
Dissatisfaction with taste, texture, or appearance
Ordering errors made by the customer
By placing an order, you expressly agree to this policy.
Orders cannot be canceled, modified, or rescheduled once placed. This applies to all orders placed through Hotplate or directly through our website.
Customers are responsible for picking up their orders at the designated date, time, and location communicated at the time of purchase.
Failure to pick up an order for any reason does not entitle the customer to a refund, exchange, or credit.
Unclaimed orders may be discarded at our discretion.
All baked goods are handmade in small batches. As a result:
Size, shape, color, and appearance may vary
Products may differ slightly from photos shown on our website, social media, or marketing materials
Such variations are normal and do not constitute defects or grounds for complaint.
Our products are produced in a home kitchen operating under California Cottage Food Law.
Required Notice:
This food is made in a home kitchen and is not subject to routine government food safety inspection.
Our kitchen may handle common allergens including, but not limited to:
Wheat
Dairy
Eggs
Tree nuts
Peanuts
Sesame
We cannot guarantee that any product is allergen-free. Customers are solely responsible for reviewing ingredient and allergen information prior to ordering.
Orders for baked goods may be processed through third-party platforms such as Hotplate.
We are not responsible for:
Platform outages
Payment processing errors
Technical issues
Account or notification failures
Actions or omissions of third-party service providers
By ordering through a third-party platform, you also agree to that platform’s terms and conditions.
Certain non-food or shelf-stable items (including but not limited to coffee, honey, mugs, and merchandise) are sold as-is unless otherwise stated.
All sales remain final unless required otherwise by applicable law.
To the fullest extent permitted by law, The Tarte, LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from:
The purchase or consumption of our products
Allergic reactions
Failure to follow storage or handling recommendations
Missed pickups
Third-party platform issues
Our total liability, if any, shall not exceed the amount paid for the specific product giving rise to the claim.
By purchasing and consuming our products, you voluntarily assume all risks associated with food consumption, including potential allergic reactions or sensitivities.
All content on this website—including text, images, branding, logos, and product descriptions—is the property of The Tarte, LLC and may not be used, reproduced, or distributed without prior written permission.
